eBay exempts ham-band-only radios from new FCC ID listing rule

Hams selling transceivers on eBay can keep listing radios that work only on amateur frequencies without an FCC ID number. eBay gave that assurance to ARRL after rolling out tighter rules for listings of radio transmitting equipment.
The change follows FCC rules that took effect October 13. In its Third Report and Order, issued July 23, 2026, the Commission said online marketplaces share legal responsibility for keeping unauthorized RF devices off their platforms. The FCC says the rules are meant to use its equipment authorization program to guard against national security threats to the communications supply chain, and they reach a wide range of products. Going forward, a seller listing equipment that is subject to FCC authorization must give the marketplace the item's FCC ID, and the ID must be posted with the listing. Listings already online, "small sellers" and used equipment are exempt.
Early messages from eBay to sellers suggested that any RF-transmitting item would need an FCC ID to be listed, so ARRL asked the company to clarify how the policy treats amateur gear. An eBay spokesperson replied: "eBay allows the sale of devices capable of operating only on frequencies that the FCC has allocated for use by Amateur Radio Service licensees. As these devices do not require FCC equipment authorization, FCC IDs will not be required for these listings as an amateur licensee may use his or her license to operate such radios."
The exemption has limits. The same statement said two-way VHF/UHF radios capable of operating outside the amateur bands cannot be imported, advertised, sold or operated in the United States, on eBay or anywhere else, without FCC equipment certification. That covers many inexpensive handhelds that transmit well beyond the ham bands.
ARRL stressed that the FCC did not change its underlying equipment authorization rules. Amateur radio equipment still does not need FCC authorization, with the exception of commercial HF amplifiers.
If eBay restricts a listing by mistake for a device that needs no FCC ID and is otherwise authorized, the seller should tell eBay. The company said it will then decide whether to lift the restriction.
